If the cost to repair, remodel, or improve a structure equals or exceeds 50% of the building’s market value (excluding the land), the entire structure must be brought up to current floodplain management standards.

When Does the 50% Rule Apply?


The 50% Rule kicks in when:


  • You’re making repairs after hurricane or flood damage

  • You’re planning a major remodel or addition

  • Your home is located in a FEMA-designated flood zone

  • The cost of improvements equals or exceeds 50% of your home’s assessed or appraised value (excluding the land)



How Is the 50% Calculated?


The formula is simple but the documentation isn’t. Here’s what’s factored in:


  • The cost of all materials and labor

  • Structural, electrical, plumbing, HVAC, drywall, flooring, etc.

  • All work must be itemized, even if you plan to DIY

  • Costs must be submitted to your local building department for review


Your property’s market value is typically based on Charlotte County’s tax records or a qualified independent appraisal (excluding land).



What Happens If You Exceed the 50% Threshold?


If your repairs or improvements go over 50%, your home must meet current FEMA and local flood regulations. That could mean:


  • Elevating the structure to or above Base Flood Elevation (BFE)

  • Upgrading foundations, mechanical systems, and flood vents

  • Meeting current building codes and wind load requirements


In some cases, especially in older homes, this can dramatically increase project costs—or require a tear-down and rebuild.
